Builder delayed possession of flat how can i get back the payment made

I have booked a flat in Dec 2012 with express builders (office in cp Delhi) for project express eternity in greater NOIDA west. Builder is neither building the project nor acknowledging the plan to not build the project in written. Verbally the person looking the project is saying they will not build the project now. 6 months back they did Tripart agreement and now saying they are not liable to give any interest. How can I get my money (50% of the flat cost I have paid, part payment through bank loan) back. Can push builder to give interest on the money?

Sir,
You have two remedies available. One is to approach civil court and the other is to approach consumer court depending upon the amount you have deposited. These days courts are inclined towards consumers who lose their hard earned money. Regards

Thank you for your question. A case in the consumer court can be filed against the Builder for delay in possession. You can either pray for refund of amount paid along with interest or alternatively take possession when the flat is ready with compensation and interest. The Courts have come down heavily upon various reputed Builders who have duped innocent consumers and expropriated their money.

Send them a legal notice first. Thereafter, if they don't pay, then file a consumer case against the builders to refund your money ALONG WITH INTEREST.
P.S.: It is advisable to go through each of the clauses of all the agreements properly.

Yes you can claim refund along with interest for deficiency in service by builder. We can approach consumer court for grant of relief. Reciently courts are granting reliefs to the consumer.Please contact us for details.
