Builder asking for interest on balance payment dont wish to buy it now

* Have given 50% of total flat amount, * project slow in appreciation. * builder never asked for balance payment says u can pay later. * but now hes asking for interest on it @24% on balance.for 2 years * last month we met n he says that he n my dad has good relations thats why we never asked for balance.. * had an agreement too.(at the time he insist thats its a formality only) after some time we realised that theres also a connecting or common road to another society and other builder plots were up for sale.. which he never told us about. I really dont like the project. I want out. what can I do to avoid interest on balance payment? Thanks.

Hi, If you see any defects in the service provided by builder to you then definitely you have a way to approach consumer court to put your grievances. Now you want to opt out of the project, you have to share complete documents like agreement between you and builder etc so that the suitable legal remedy may be suggested to you.

Agreement executed between you and the Builder will have to be examined.
However, if there is delay in possession and the date agreed for possession has already expired, you may seek refund of the amount with interest.
I reiterate that a conclusive opinion can be only given after examining the Agreement between you and Builder.

You can file a consumer complaint as per the pecuniary jurisdiction of the forum. complaint should be drafted properly in order to get effective order from the forum. as per the facts you share, in fact you get the compensation.
