Brought phone from website got defected product. what legal action

Hi, I had ordered a mobile phone in an e commerce website, the product was delivered and and found that the product and its accessories to be fake. I reported it to the company and they said they will replace the product, after few days the product was picked up by the courier, after 15 days didn't receive any phone or anything, called customer care and they said they don't have other product so they will initiate refund within 7 days, but its been 1 month still no refund received. Called customer care again but they are providing fake promises as it will be done next week. This is third time

Issue a legal notice to the concerned department of the mobile phone Company subject you should have preserved the invoices of the mobile purchase. thereafter depending on the reply from the mobile company or the service agents, you can lodge a consumer complaint before the jurisdictional Consumer Disputes Redressal Forum for claim of your amount with interest.
