Bank loses original sale deed documents. What should be my next step?

01-Oct-2023 (In Consumer Court Law)

I had taken a housing loan from LIC in the year 2010. This loan was taken over by HDFC housing last year. After the closure of the loan LIC has not been able to retrive or return my original sale deed documents. They have misplaced/ lost the documents. HDFC is pressurizing me to close the current loan since they do not have any security for the loan that they have provided. Though LIC has assured me that they will get a duplicate document created. This is a major deficiency in the service and the property value seems to be questionable as there are no original documents. Next steps?

Hi sir/madam, LIC has liable to be the same to compensate with terms of money by filing the petition before consumer forum. If you have the copies of the said documents, you have to take duplicate documents by narrating the actual facts in affidavit and the said affidavit to submit before the concerned authorities and to get original copy of the duplicate, and proceed with necessity work.

Hi,

Going by what you have shared herein, it is advised that LIC can be sued for lost of documents since the same constitutes deficiency of service on their part. Also take in return from the LIC regarding alleged loss of documents.
