Association Treasurer's liability if cashier misappropriated

02-Oct-2023 (In Consumer Court Law)

Dear Sirs, Five years back when I was Treasurer of our Apartment Association, Cashier of Association misappropriated Rs.51000/-. He had admitted misappropriation . In General body meeting of the Association, decision was taken that Office bearers should lodge Police complaint to collect the money. Then Police complaint was lodged. Office bearers could not collect the money. Now (ie., after 5 years), the present office bearers have passed resolution that the Treasurer at that time (ie., me) should pay the money to Association. Is this resolution valid? What I should do. Regards.

The office bearers have no rights to pass such a resolution. This is in violation to the bye laws of the association. The treasurer was not the employer of the culprit cashier. If the money could not be recovered, the association in a general body meeting has to decide about waiving it off
Ask them to issue a demand letter form this, you can issue a legal notice questioning the validity for this demand from you.
You can even contemplate to sue them for defamation offence.
