without complete renovation work presharise for remaning payment

13 months back, i gave the contract of 2 bhk flat renovation to the local contractor. it is on 19th December 2017. due to some society members objection and internal road work started by pmc , the work has delayed. when rainning was started contractor said , that the remaning work will done after raining . in this perod he never ask me Or call him self for the work. now from 8 to 10 days suddelly he start calling me morning, afternoon evening, knight to paid remaing payment Rs.22k i ask him to do complete remaing work. he told that he will not do the outside wall plaster. he is asking me to pay Rs.11k extra for out side wall plaster. i am not agree. because i gave him whole contract including outside wall plaster. now he is hareshing me to pay all.
please suggest me what to do ?
could i file the plice complent againt him ?
can i send him a legal notice by Advocate ?
A contract whether written or oral is a contract after payment or consideration is made. If he is harassing you, you can give police complaint, moreover you can send a legal notice to him if he is a company or individual running a business you can even ask for compensation . The work needs to be completed by him as agreed. also to added there are many instances of these contractors harassing their clients to extract more money in between completion of work , its some what of a scam. so next time always remember to write down contact and the monies to be paid in advance its a good practice.
