We have a disputed property issue with a relative. Had an ex parte order in our favour in 2006 because the defendant never appeared in the court knowingly. In 2012, the Amin came to the site for the execution part. But the decree debtor/defendant threatened the Amin. The Amin reported in the court that the execution requires police force. We submitted the police force fee in the court. But the execution has still not taken place. The defendant bribes the judges and now the case has taken a new turn. The defendant's appeal for objections to the decree have been accepted even after a time of 7 plus years even if that needs to be done within a stipulated time. The judge now says that the defendant needs to be heard and the ex parte order can be over turned.

Since it is an order of a higher court, the district court is bound to comply with the same. However, you can engage a lawyer and contest the case before the DC in case a suit is filed. In case they do not file the suit, you can continue with the execution of the ex parte order passed in your favour.
