Want To Withdarw Rape Case

My brother had a relation ship with one married women and she launched rape case on my brother but after that she realised and give a petetion that she do not want to continue the case and my brother got bail basis on this... now how can stop the case charge sheet given but he did not take the case on trail till.ow.. it is 1 year going..
as it is compound case she has stood before court and she has to give such statement then d case will be not maintainable but is d accused appearing before the court ? after seeing the record of the case rest can b advised otherwise can be withdraw but not directly
