suppression of neighbor for my construction

I'm a resident of New Delhi im hindu (so i guess hindu succession act )let me explain to you the basic background of my issue. I live with a joint family but everyone owns their private land .so total property is about 1000 gaj my uncle (chacha )is constructing their portion but my other uncle (fufa) he is police department so he called cops like 2-3 times and claimed false allegation against him and not letting the construction begin so what are the legal actions can be taken against him . over more some clues lead to a conclusion my uncle (fufa) is a black money holder
Hello, I have perused your query. In case you live in a joint family setup and the property is ancestral in nature then everyone is entitled to an equal share in it. Moreover if their is an existence of a certain family arrangement between the joint owners and as per the same if your uncle is trying to construct his part of the property, he can do so. However , if the property is not subjected to partition yet then a partition suit needs to instituted for crystallization of everyone's share in the property pursuant to which construction in respective portions can be done.
