14-Aug-2023 (In Civil Law)
My wife"s father was partner in partnership firm along with his sons . After his intestate death one year back ,her brothers are continuing business in same name . How can my wife seek her share in firm's properties /assets/goodwill at the time of his death and share in profits or interest after his death .. should she file partition suit or suit for dissolution of firm . She only knows about name of firm . Her rti application was relplied that department need firm"s registration number and year of registration as records are not computerised . Kindly advise suitable course of action .

Without going through the contents of partnership, it is not appropriate to advise you in the matter. If you know the details of assets of your wife"s father and if she wants her share in the assets of her father, she can file partition suit including share in the profits of the partnership firm.
