Hello, I am a student doing some research into sexual harassment law and legal solutions in India and thus was looking for some further information on what potential legal action can be taken against ogling/ staring and facial expressions that someone may find uncomfortable on the streets. Is there any legal action that can be taken and if so could you perhaps outline the steps to go about filing such a complaint and what could be the potential result and turnout? Hi,
To get answer of your query a close reading of the Section 354 A, B, C and D of Indian Penal Code 1860 is required to understand the offence and the law concerned. The provisions were introduced in the penal code after the Nirbhaya incident at New Delhi to deal with sexual harassment and punishment for sexual harassment. If one stares at a woman continually for some time, he could be booked for stalking or even voyeurism. Section 354 D (iii) specifically provides for the same. Staring is an offence if it makes a woman uncomfortable even for a few seconds. Womenfolk can register complaints against such offenders in police stations.
