provisional registration of mental health establishment under MHCA

27-Jan-2023 (In Civil Law)
I have applied for deaddiction centre license 5 months ago in haryana. As per new Mental Health Care Act 2017 effective from May 2018, government has to give provisional registration within 10 days, issue new guidelines of minimum standards for different categories and then inspect the centre before giving permanent registration. However they issued a letter for certain changes after 4 months which were complied within 5 days and informed in writing about the same. But even after 5 months and 3 inspections the license is being delayed. Is there any legal remedy to enforce the Mental Health Care Act 2017?

In case the competent authority under the act is unnecessarily and unjustifiably delaying the issuance of license in your favour, then in such a scenario you are well within your rights to approach the High Court with your grievance. Feel free to contact for further legal help.
