One partition suit against my younger brother after that he show sale deed After that I file to cancel the sale deed all papper are wrong my witness is done when the time of defendant witness Adv of defendant put a affidavit Evidence by way of affidavit of the defendant can it's possible court accept it no need of defendant Evidence he know very well all the papers is wrong if the DE is done he lose the case there is any law

what is your query? contents are confusing. details are required to suggest remedy. if evidence by way of affidavit has been filed then the same is not conclusive and opposite parties can cross examine the witness on the basis of filed affidavit. court cannot exceed its jurisdiction by accepting affidavit as conclusive and by denying DE. if required consult with detail.

Hi. In the facts disclosed in the query it appears that there are two issues, one challenging the sale deed executed without your consent and the other partition. From the facts narrated it appears that you have a preemptive right in the property. In the suit challenging the sale deed and the partition you will have to claim your better right to purchase the share of the other brother.
