Procedure claim share from inherited property

13-Jan-2023 (In Civil Law)
My grand father acquired a plot of land allotted by a very old cooperative housing society . The society have no title deed , hence all the plots are alloted in their books and no registry have been done as such grand fathers plot is also has no registry documents. My grand father, when he was alive, gave an application to the society to transfer the plot in the name of one of my brother, accordingly society transferred the plot in my brothers name in their books. My grand father had two sons, one having three married daughters and other son having three sons and two married daughters. My brother has build a house in 1/3 portion of the plot. My brother has already transferred 1/3 of the plot in favour of my elder brother and approximately 1/3 plot is vacated. I thought that this is my share and now I asked him to transfer the 1/3rd portion in my favour in the books of the said society. He is saying that you have no right in the plot. Can I claim my share, legal status.

See the plot land was your grandfather's self acquired property and he could transfer it the way he wanted to. In this case as your grandfather asked the cooperative to transfer to property in your brother's name so you can't dispute his right. But you must find out whether the transfer is genuine and it has been because your grandfather wished so and there is no fraud involved. You also should find out whether the society has the power to transfer the property in the manner it did.
