Need information regarding direct beneficiaries

09-Jun-2023 (In Civil Law)
The Assistant Charity Commissioner in Gujarat is not allowing a trustee's wife to work in a school run by same trust saying a trustee or its relative can not be direct beneficiaries. Is that right? If not under which section she is allowed to work as an employee. He is saying that under MAHARASTRA TRUSTS ACT 1950 it is not allowed.

Sir, which section or rules do not permit it. Wife or relative cannot be beneficiary. Beneficiary here means that the no contract of the Trust can be entered in which the Trustee is to decide the person or organization to whom that contract is to be given. In normal circumstances, appointment of teacher in any trust run school are made by a committee and not the Trustee alone. Where ever it is done by committee, the wife can work.
