Made payment to landlord and he died now what should we do

We have given the amount to buy a house to landlord.Suddenly he died but we dont have any proof.Except he is having a diary with the details.What to do now?
You can file a recovery suit under the Provisions of Civil Procedure Code but the suit will only sustain if you have made payment in cheque or Demand draft. If the payment has been made in cash, then you do not have any proof of payment. Please note that the Diary will not sustain as the material piece of evidence or proof in your case.
