03-Sep-2023 (In Civil Law)
One of my agent has collect 4 lac in cash mode in March 2017 now he has been leave city with family. Customer told me to file fir his name but along with my name also . Employers are vicariously liable for negligent acts or omissions by their employees in the course of employment (sometimes referred to as 'scope of employment). For an act to be considered within the course of employment it must either be authorised or be so connected with an authorised act that it can be considered a mode, though an improper mode, of performing it.
All you can do is to try to convince that person to register FIR against the agent only and you can assist and hlp him in whatever way possible. In case a case is registered against you then you should hire an advocate and prepare strong defence against the vicarious liability of Principal in a Prinicipal-Agent relationship.
