Housing loan EMIs under tripartite agreement

Hi, I was cheated and forced to take housing loan under tripartite agreement. I taught Mr. Latish was d builder but found someone else is Builder. However, Amount disbursement happened keeping my KYC and income proof. Hence, Bank is asking to pay d EMI.. I m not in the situation to pay I want to close it but bank forcing me not to close and continue the EMI..

Hi on the basis of your query it is understood that the contract/tripartite agreement was entered by force and through illegal means. Please note that Duress makes a contract voidable. Duress is a means by which a person or party can be released from a contract, where that person or party has been forced or coerced into the contract. If this coercion can be shown to be true then the contract entered into cannot not be considered a valid agreement.
