Eligibility for getting Gratuity payment.

I hv joined as staff in a partnership firm on 1st June 2010 & retired on 1st July 2019. My DoB is 20th Dec 1952. EPF deduction was started from July 2012 salary. Co is denying payment of Gratuity on the ground when I hv joined with them my age crossed 58 yrs, taken into consideration of EPF deduction date. Pls note I hv no proof joining date as they are not issued appointment letter.

To be eligible for gratuity under the Gratuity Act an employee needs to have at least five full years of service with the current employer except in the event that an employee passes away or is rendered disabled due to accident or illness in which case gratuity must be paid
