I am the defandant in a civil court. The next issue in my case shows call on for amended plaint. I wanted to know the detailed meaning of amended plaint
Order 6 rule 17 of cpc deals with amendment of plaint. If in the plaint i.e., pleading of plaintiff if there are any averments to be amended or if any averments are to be added which were not present in the plaint filed then the plaintiff can seek amendment of plaint under Order 6 rule 17 cpc. And only such averments can be added or aletered or deleted from the plaint which doesnt not change the nature of the suit n which are necessary for determining the real question in controversy. The amendment sought for should also not be in the knowledge of the plaintiff when filing of the suit. The same thing applies to defendant if he wants to amend his written statement.
