Can housing society restrict the visitor's parking and ask penalty

I hav been allotted a car parking in my society where I am the owner of a flat.We hav 1guest parking in our society.My friend visits my place every day &park her car in the guest parking for the duration she is at my place,now my problem is that my society has issued me a notice stating tht they are seeing my visitiors same car everyday for few hours in the guest parking &has told me tht if the same car is noticed for more than 2days they will charge me for a month &hav asked my visitor does not park her car in the guest parking.My question is that is this right on their part to make such a demand.can d housing society restrict the visitors visit and parking even if my guest is coming on regular basis.Is it as per law they can demand such penalty from me..Thank u

Has the society passed any resolution with respect to this decision to levy penalty?.If they have passed a resolution you can challenge the resolution in the cooperative court by filing dispute. Please appoint a good lawyer

Guest Parking is an amenity in common to all the residents. As long as the guest is with you in your flat, you can use the guest parking to park her car.

Society already receives maintenance from you for the common amenities provided. Therefore, society can not ask for any additional charges against the guest parking.

RERA does not have any specific parking rules. Parking rules in India's residential areas state that 5% of all parking spaces should be reserved for visitors.
