Can an accused judge of 498a head a family welfare committee

Can a 498a accused judge head the Family Welfare Committe.? case is under trial. But stay order obtained from higher court? Since the case is on trial can the same retired judge head the Family Welfare Committees?
If others members of the Family Welfare Committee considers judge fit and eligible can/may proceed to head the Committee because of the stay from the higher court and also the Committee wait till the outcome of the pending trial and accused is found not guilty.
