Appeal or stay on higher court judgement in high court.

We did the sale deed on revenue land with three month time, but purchaser came after two years. So send legal notice for forfeit of given advance. Then they filed a specific performance case. in that case, court given a judgement to return back their amount with one percent interest. then purchaser appealed in higher court. The higher court given adverse judgement to register property to them. So we have to appeal and need stay on judgement. kindly suggest what would be our next step. Thanks Regards. Ramakrishnachar

As rightly pointed out by you, you will require to file an appeal before the higher court depending on which court will be the next one to appeal to [depending on which court decided the previous order you may need to approach the high court or the supreme court]. Along with the said appeal you will need to file an application for stay of enforcement of the judgment of the previous court. During the stage of admission, if notice is ordered by the High/Supreme Court you will also have to request for granting a stay order as well.
