Will my brother get custody of 4 year daughter who lives with him

My niece is living with her paternal grandparents we both sisters and mostly with bhai as she prefer job over taking care of her daughter.But suddenly she has started torturing us for child custody altough my niece doesnt know whos she? As she rarely comes home even after living so close cities. Always give importance to her job and carreer. She has aborted another child too. to fullfill her dreams. Will my bhai will be able to get custody of her daughter as she is happily living with bhai me and her grandparents?
