Wife has deserted and taken away child with her

23-Sep-2023 (In Child Custody Law)
My wife has deserted me and my son and shifted to rental flat. Now my son is suffering from cancer and she is not allowing me to meet him and threatening me to keep away from her. I have suspected some affairs going or some one might be brain washing her. She is asking me to give her divorce. My flat is on joint name with her and Im paying monthly emi, now she is not staying plus not even allowing me to sell the flat and get rid off. This is happened since last one month and I'm currently staying with my parents Kindly advise solid solution.

hello, have been through your query and i think she cant stop you to meet your son as there is no judicial seperation or divorce between you both and about your flat depends upon the sale deed which need to be rectified by me in person!

I need to know some more from you like 1) don't you want divorce from her. 2) what is the age of your son , if he is minor then you can file case in court for his custody and meanwhile you can also get the access I.e order from court to meet him . 3) don't leave the possession of your flat at any cost , this is my first suggestion to you which is most important. 4) if she wants divorce then ask her to release the said property I.e your Flat and get divorce if you to want divorce from her then only. For further more solid solution you need to meet so that more legal ways to get rid off can be shared with you. But remember possession of flat is the most important thing you need to do.
