Wife committed suicide, case in court, can I take custody of child

My wife got sucide 6 month back and 306 is going on in Trial court. Can i get my son's custody who has been staying with my mother-in-law from last 3 yrs?
Yes you can take custody, first call them to give custody if they deny please take the help of police and even if police fail to help you , then file a suit in family court for custody of child as you are the legal natural guardian.
