Whether child custody paper is required for filing visa application

mother got divorce this year one sided , no response/argument from other side, child is living with mother since 6 year during marriage of 7-8 years, mother is in abroad based on study , want to carry daughter. lawyer is asking custody paper for filing Visa application . How to proceed ? lawyer who process the divorce case , says no need of any custody paper as child is living with you six years.need solution
Dear the custody of the child should be clear either in divorce judgement or otherwise you will have to file a separate case for the custody of the child under child guardian and ward act, your embassy will ask the custody papers.
