What is the procedure for child custody

My son (2yrs 4 months) and I am living with my parents for 9 months. My husband is in Canada now. Is there any chance that my husband gets the custody my son if we get divorced?
As per the current law. If you seeking for divorce and custody of child..it purely based on court and both parties financial capability for welfare of child. Therefore you can plead court to custody of child to father as you aren't earning enough to facilitate child
