Want to marry divorcee girl who wants to give her child to brother

I want to marry a divorcee girl who has 4 year old son. She want to give her son to his married brother for legal adoption. What is the procedure for this?
I presume that the custody of the child hascbeen legally given the divorcee then she can give the child in adoption to her brother but brother must not have male child only then he can adopt the child. Then the must be physically taken and given in adoption by performing a religious ceremony then an adoption deed can be written and registered in the office of sub registrar
