An application was moved by the mother to get maintenance of child under dv act. Along with that she attached a medical documents which shows that mother is not keeping the child well as the child is suffering from several disease. Is it possible to get the child custody back at any stage of proceedings of dv act.
Yes, if the mother is incompetent to maintain the child properly in all aspects and the child is not too small then custody can be taken by the father.
