आपने यह नहीं बताया कि आपकी बच्ची अभी कितनी उम्र की है । यदि बच्ची की उम्र 5 वर्ष से कम है तो न्यायालय सामान्यतः बच्ची की कस्टडी माँ को ही देता है, किन्तु यदि आपकी बच्ची की उम्र 5 वर्ष से अधिक है तो ऐसी स्थिति में न्यायालय कस्टडी देने से पूर्व यह देखेगा कि आप दोनों में से किस के साथ रहने पर बच्ची का भविष्य सुरक्षित है ।

First of all, if possible bring some elders/wellwisher/friend who is reliable for both of you and initiate the conversation. You can talk to your husband regarding the same. If it works out, the decision to be together or divorce by mutual consent can be taken. You must know that in custody of child Court sees welfare of child. Being a girl, your daughter's growing needs require physical presence of mother more. So getting custody of child through court if the child is with you is not that easy for your husband. If you decide for mutual divorce, you can work out on terms like permanent alimony in which you can ask a lump-sum amount towards your maintenance and child's maintenance, work on visitation rights of father and others. You can approach High Court Mediation center (In the case off cities like New delhi etc) or Mediation Center at Lower Courts (U.P.) and an application on simple paper writing briefly about your situation your can get mediation done.
