My daughter is 8 months old . I want my child custody

My husband beats me so I came to my home but he didn't gave me my child . I want my 8 months old daughter custody as soon as it's possible . What should I do for that . Please. Suggest
you have legal right  firstly file a police complaint of domestic violence and mental cruelty at the jurisdictional police station then file a divorce on ground of cruelty under section 13 hindu marriage act. Further since child is in your custody if he files for child custody same can be contested and since child is such tender age he won't be given custody
