Mother committed suicide who will take care of the female child

HINDU UN DIVIDED FAMILY. Who will take care of female child when childes mother suicide herself. Clearly mention in her letter nobody response for her final decision. Postmortem reports indicates only suicide. Grand parents refuse to hand over (female child age about 4) to his father and their family consists of father's mother,brother,brother's wife and brother's 2 children's. What is the appropriate action to collect child ?

AFTER THE DEMISE OF MOTHER THE NATURAL GUARDIAN BEING THE FATHER HE WILL HAVE THE CUSTODY OF THE MINOR CHILD
SINCE THE DYING DECLARATION / DEATH NOTE CLEARLY INDICATES THAT NO ONE IS RESPONSIBLE FOR HER SUICIDE. SO THERE IS NO SUSPICION ABOUT THE ABETMENT OF SUICIDE BY THE HUSBAND. IN ANY EVENTUALITY IF YOU WANT TO HAVE THE CUSTODY OF THE CHILD YOU CAN FILE CASE UNDER THE HINDU MINORITY AND GUARDIANSHIP ACT, 1956.

Better file a custody petition in the court narrating the facts and as well make a plea before the court that why custody of the child is necessary in your hands. Court must be satisfied with your pleadings for that you need to establish that the welfare of the child is well protected with the particular person only for seeking custody.
