Imminent separation leading to child custody

02-Sep-2023 (In Child Custody Law)
I have a problematic marriage with constant verbal altercation between my spouse and I, we live with my parents in thier home and have a 2 year old son. She is a working woman and I am a stay at home parent. I look after the baby while she is away. We have differences and they do not seem to be coming to an end. She also is trying to draw a wedge my parents and I by telling them things of which only was privy so that it breaks their trust in me. I do not wish to let go off my son for multiple reasons including that my parents and I are in a better financial position and have better educational background to make sure his future and education are secured. My parents are ageing and can not leave them alone as I'm the only child. I'm a Hindu.

if you are unable to sort out disputes between you and your wife it is advisable to get a divorce by mutual consent. as far as child custody is concerned, law says it has to remain with the mother till he or she is 5 years old and there after you can apply for custody however you cannot be denied visitation rights. if she mutually agrees for giving away the custody you can get it otherwise another option is to retain the custody of child and let her file application for custody and you can defend it
