How to prevent father to claim his right on child

My husband threw me and my kid out of the house. Kid is with me. How to prevent him to claim his right on child in future. Do I need to file any custody case even though child is with me. Plz suggest
What is the age of your kid, ? If it's under age of 7years than you have first to custody your child. After that court ask to the kid where he or she can live with you or your husband. If your husband file a custody you may give good reply and take your mid in your custody by court order.

पहली बात तो यह कि जब बच्चा आपके ही साथ है तो आप चाइल्ड कस्टडी का केस दायर नहीं कर सकतीं हैं।
दूसरी बात यह कि आप बच्चे को अधिकतम 7 वर्ष तक तो अपने साथ रख सकतीं हैं किन्तु भारतीय कानून के अनुसार चूंकि बच्चे का पिता ही उसका नैसर्गिक अभिभावक होता है, अतः ऐसी स्थिति में यदि आपके पति बच्चे की कस्टडी प्राप्त करने के लिये केस दायर करते हैं तो आपको यह सिद्ध करना होगा कि आप बच्चे की अपने पति से भी बेहतर परवरिश करने में सक्षम हैं।

Yes you have to file a case of child custody till the age of 18 years of child. after that child is free to live with whom he/ she wants you can also give and application in police informing about father cruelty towards you and child as that will help in claiming child custody towards you. contact if you are in Noida, Greater noida , Ghaziabad or Delhi.
