How to get custody of a 2.5 years old girl child

Last two-three years my sister(Religion: Hindu) suffering from mental torture from husband and father in laws. Finally, husband asked her to leave his house and my parents travelling to mumbai to pick her up. My sister has 2.5 years baby girl and her husband may denied to take the baby girl with my sister. What legally can be done to get the girls custody in current situation.? what law says and where we can get help? Thanks in advance.

Hello sir under hindu guardianship and ward act clearly says that the age of 5 child lives only with his mother but in some circumstances it may be denied but mother is the 1st how has power to take custody of there child

Hi, as per section 17 of the Hindu minority and guardianship act the welfare of the child is the paramount consideration and if you able to prove the welfare of the child in your custody then court will handed over the custody to you but before passing the order child age and other factors also considered by the court.
