How is child custody determined during divorce?
26-Aug-2023 (In Child Custody Law)
I am a working woman and thinking to get divorce due to conflicts and irresponsible behaviour. I am having 5yrs old twin boys. Since the day I conceived m staying with my mom at her place and even after kids birth. My mom is the support for my kids and she too is working,my kids are inseparable frm my mom. My husband too started staying with us when i was pregnant due to his dad's insane attitude. My husband work till Late hrs. So only time he sees my kids is during fri n sat as his arbic weekend. Recently my husband started staying with his parents as they require his support and I totally respect that, this as no influence in my divorce decision. As its solely due to our frequent unresolved conflicts. My in-laws, my husband were not present effectively in my kids life. Even though my husband loves kids alot he is least interested in kid's upbringing and has his own priorities in life. So who will get the kids custody n Assume tat it wont like 1 child with 1 parent
It depends on the age of the children and their interest in either of you. Generally the custody lies with mother as the children are attached to her. While taking divorce mention a clause that custody of children will be with you permanently and he will not custody of children from you. He have right to have access to the children but have a custody in your favor. Take it in writing from him that he will not file any suit for custody in future. If the children are with you and you are taking care of them properly your husband will not get custody.
