I have two daughters, elder (4 years) and younger (2 years). My wife has an affair with someone. She wants a divorce from me in order to marry with him. I want the custody of my both daughters because i don't want to marry again. What to do, Kindly advise me.
you will have to file a case under section 13b Hindu marriage act 1955. In this case all the condition should be mentioned what do you want like custody of children in this case all the disputes between both of you will be resolved

you can get custody of your children provided either you prove that your wife has an illicit relationship with some other man or through the mutual agreement in a family court. othereise it is very hard for a father to get the custody of daughters but definitely in other case you will get visitation rights.

Ideal condition is if you and your wife may go for mutual divorce retaining custody of daughters with urself and visitation rights to her as she is marrying someone else, children will not be hindrance for her new life.
In the case of contesting, you may file an application under section 25 Guardian and wards act in the court of the city of residence of your daughters.
