Child Custody to Grand parents

One of my cusion (My uncle's Daughter) sister got suicide 2 yrs back and her husband is charged U/S 306 and her son is staying with her grand parents from 4 yrs onwords (By birth onwords). if my brother-in-law file petition for Child Custody, to whom the judge will give the child custody. Whether grandparents or brother-in-law(Sister Husband)
in this case as the child is in custody of grandparents and as the father is charged with an offence, looking to the welfare of the child and if grandparents are in a position to look after the child then the court will not give the custody to the father but will keep the custody of the child with grandparents, further in child custody matters only the welfare of the child is given importance, for more details you can contact me.
