Child custody of the brother who died from his wife

My brother died due to cardiac arrest his wife behaviour is not good during 1yrs of marriage can we have a custody of my brother child .
No unless you prove that the mother of the child is mentally unstable you can not and you should not try ,it is the welfare of the child which is utmost importance while deciding the custody of child .mother is the natural Guardia and up to the age of 5 years minor child the court are not inclined to grant custody of minor to even father you are not even the father .so no chances to succeed.
