Child custody before getting divorced

I m married in 2017 and having kid of 5months and I working girl. I can claim on my husband about domestic violence as he used to physically n verbally abused me. He don't value me and all his decision are indirectly influenced by my mother in law. Now I don't want to go back to his place as I cannot tolerate him n my inlaws anymore and want my child to be with me coz he needs me most.. Plz tell me whether I can get child custody of my kid
