Hello
Cheque is considered as dishonored if account is closed, balance in insufficient or signature differ..In this case the cheque is dishonored take dishonour memo and issue legal notice first and then file criminal case under section 138 of NI act and 420 IPC

You can file complaint under section 138 ni act for that you need to give a legal notice first demanding payment withon 15 days and after that you can file complaint in court. Make sure you do so wirh in one month of dishonour of cheque.

Dear queryest it's falls under no act coz he)she issued the cheque of that account not in operation thus he/she is punishable as per provision of no act so do not think too much about it just server the issuer with notice withing 30 days after cheque bounce report

This is an offence under the provision of section 138 of Negotiable Instrument Act,this is a very technical case in which you have to send Legal notice within 15 days from the date of dishonour of check and thereafter you have to present a complaint for the same in court within 30 days,don’t miss out time in this matter else you have to pay the fee for recovery of the same.

You can file a complaint under section 138 ni act against him. But first of fall you gave a legal notice to him through a advocate. You can call me for more knowledge and further action against him.
