Presented cheque in the bank but drawer's account had no money

I had presented a postdated cheque at my bank and it was returned saying there’s no balance in the drawer's account. When I asked for a cheque return memo, they said they can't give one because it is not a clearing cheque (the drawer’s account is also in the same branch). When I insisted saying that I intend to initiate legal proceedings, they asked me to wait for a few days. I presented the cheque the next day and even then, the drawer's account had no balance. I asked for the cheque return memo again and they said the manager was not in and asked me to come in the evening. When I went in the evening, they gave me a cheque return slip saying “Payment stopped by drawer”. It is clear that the bank had alerted the drawer and got the cheque stopped to avoid charges under section 138. Can I get the bank statement of the drawer’s account and a statement showing the time and date of the instruction to stop payment, to present as evidence? If yes, what is the procedure?
