Sir /Madam, the cheque was bounced in the year 2017 the complanainant issued a legal notice to me demanding for his money, I received the notice and replied to him that it was a false cheque bounce then he didn't give any reply to me and he didn't file any case also but after 2 years that means in the year 2019 he filed case against me, to my knowledge I think he had to file a case within the 30 days of offence done ,but he didn't do that and filed later after 2 years I wonder how the court allowed his case and he didn't show any proper reason for late filing the case, how should I move in the case, now the case was in appearance stage can I file dismissal petition in this stage r should I wait for sometime

you are right in saying that the cheque bounce case has to be filed within 45 days from the date of receipt of notice.
please check the court records to find out when the case was filed and when did judge take cognizance of cheque bounce case.
based on these data, you can file a quash petition in high court under section482 cr.p.c
