Is PCR Necessary in case of cheque bounce
22-Aug-2023 (In Cheque Bounce Law)
Hello, I am fighting a financial fraud case committed by a acquaintance. He gave me two cheques, of which one bounced on March 30th 2018 (ChequeA) & second one bounced on June 30th 2018 (Cheque B) I served him legal notice for Cheque A which he declined to acknowledge, post which I filed a PCR in the court. The court has served him two notices already & the third hand summons will be given this week. Now My Question is, 1. Will I have to file a PCR for ChequeB? [ as this time he has taken the legal notice from the lawyer, Not responded though] 2. Should I wait for his response to the hand summons for ChequeA, due on Sep 7th 2018
Hi
You have to file a complaint for cheque B, other wise lose the limitations. Then you can't file criminal case, the option is only civil suit for recovery of money. You have pay court fee for civil case. But you are not clear why the cheque issued to you for what purpose.

What is PCR in court case?
A magistrate court has ordered its office to submit a Private Complaint Register (PCR) against Alok Kumar, additional director general of the police (law and Order), for allegedly assaulting an alleged 50-year-old female when he served as the acting police commissioner in Bengaluru in 2019. 20 Sept 2022
What is the full form of PCR in crime?
A private complaint record is a document filed by an aggrieved party to a magistrate, similar to a complaint file at a police station. The magistrate will direct the PCR to be the first step in criminal proceedings based on the records and evidence. 6 Apr 2022
Hi....for all cheque cases we have to file PCR only. PCR means private complaint . If any one issued you a cheque and it is bounced you have to file PCR case only. If court already issued summons then u have to wait till it come back.
Thank you
