Can a Disposed Case Be Reopened? Legal Options & Process

03-Jan-2023 (In Cheque Bounce Law)
My cheque bounce case got disposed in March 2017 after sending summons, but it was not settled. The reason was that no one attended the court hearings. I was not aware that the case would be closed if not attended. Can a disposed case be reopened now?

Once a case is disposed, the next step is usually to file an appeal. However, whether a disposed case can be reopened depends on the grounds mentioned in the final order. Without reviewing the case details, it's difficult to determine the exact reason for disposal. Dear Sir, if you have the case number, you can check its status online or obtain a certified copy of the full order sheet. Most likely, it was dismissed for failure to take necessary steps (summons) against the accused. Can a disposed case be reopened in India? Yes, you can file a reopening petition in the same court, but it usually lacks the power to restore the case. Instead, you may need to file a revision before the District Court or High Court. Additionally, if your objective is to recover money, you can file a suit within three years from the cheque date.

A disposed case can be reopened by a party if they are not satisfied. A relief can be granted in the event of an unintentional mistake or surprise. This will reopen the case to further proceedings. A case can be reopened if there is new evidence that could alter the verdict.
