Help me, My father cheque bounce as he was helping his friend
18-Nov-2023 (In Cheque Bounce Law)
My father wrote some cheque for a person who took lot of loan from many people and they came to collect the loan or would beat him up, so to protect the person my father just wrote few cheques, now the person fleed and the collector of loan is depositing the cheques, my father may end up going in jail for not his fault. If possible if you give some advice it would be helpful.
I was thinking that if loan collector was threatening to beat person and because of that circumstances father wrote the cheque, can it be the reason the 138 becomes void.
138 will be filed and the court will send summons. Do not worry. Be present in the court on the date that is written in the summons. Discuss the problem with the judge and take some time to engage a lawyer who will rwcord your part of the story and present to the court. You will get a copy of the complaint of 138 that is filed in the court. If you are asked to take a plea, say you refuse to accept that you are guilty. Contest the case. That is the only option you have if you are not guilty. Prove your story and only then u can escape punishment.
