Respected sir /madam, Accussed is convicted in court through a joint memo he agreed to pay my amount through 10 EMI, now he hasn't paid me and court has issued a dateless arrest warrant though if he is sentenced to prisonment , if i file civil suit recovery for my complete settlement if this possible? If yes please suggest me what's the estimated time required to recover my amount through civil suit recovery.

yes , you can file civil suit for recovery of amount but for the same you have to pay the court fees and meantime you can urge criminal court to enforce judgement also , regarding settlement chances are low , you have to find his assets to attach it and recover the amount , estimated time depends on case.

you already settled in 138 matter means you have to issue same case itself nbw non bailable warrant against him money from the same court itself otherwise you need to file recovery suit instead of filing recovery Suite you need to try to get yourself that
