Hello sir/ madam,My friend took amount from me , I had transferred it through online, the amount I had lent him is a personal loan amount and he is not paying those EMI to me, but I am paying it from my hands, he has given me a blank cheque signed and it's bounced, I have all the valid proofs such as bank statement, what's app conversation, call recordings, I have sent a legal notice to him, he is just cooking up stories to me to repay my amount, can I even file a case against him in a local police station under 420 section.
Be sure that cheque bounce case is filed within 45 days that too after issuing legal notice otherwise it will be useless. Take action immediately. Once cheque bounce case is filed he has to deposit 20 percent of cheque amount otherwise it will be disposed without hearing him. You have all chances of winning.
If you have already issued a legal notice, I hope you are following the other procedures such as waiting for 15 days from date of receipt and then filing a PCR in the court. If you have the documentary evidence, you can indeed file a case for Fraud and Cheating.
