We we're searching for a tenant, one person age 30 from Kerala came and claims he is a freelancer doing a house decoration business, his spouse is BAMS and only two will stay, we agreed from 10 Nov and says he will pay the rent after occupy, we called to ask when he will occupy on 10 Nov, then he delayed saying busy so and so but will transfer after occupy.. finally he occupy on 22 Nov with his wife without house material and still didn't pay the token rent nor deposit.. he gave too much excuses, on 24th Nov we realized he is not paying and no guarantee that he will pay.. thus, we pressurised him to leave the house and he also vacated same day, because he kept us busy with his promises we could rent to others and list one month rent so he gave us 12.5k cheque for the same and left, now he is in Kerala and have his voter ID card copy, Aadhar number, Kerala home address, we deposited 12.5k cheque but bounced, now with all evidence can we file a police case? No rent agreement was made.
Hi....you can file a case under 138 of N.I Act and after bouncing of the cheque you gave to send a legal notice to him by demanding the amount and you have to give fifteen days time to him for answering your legal notice and after the fifteen days time you have to file a case in jurisdictional court .

Police case cannot be filed on the basis of bounced cheque but you can file a cheating case with police against him. In the mean while file cheque bounce case immediately after issuing mandatory notice to him.
